1. Introduction and Acceptance

Welcome to Hcareers (https://www.hcareers.com). Hcareers is a hospitality industry classified job advertising site operated by Talentronic Corporation, a Delaware corporation ("Talentronic," "Company," "we," "us," or "our").

By accessing or using the Hcareers website, mobile applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Service.

These Terms incorporate our Privacy Policy by reference. Together, they form the complete agreement between you and the Company regarding your use of the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to create an account or use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. The Service

Hcareers is a classified advertising platform that connects job seekers with employers in the hospitality industry. The Service allows employers to advertise job openings and job seekers to search for and respond to those advertisements.

Hcareers is a venue, not a party to any employment relationship. We do not evaluate, guarantee, or endorse any job listing, employer, or candidate. We are not responsible for hiring decisions, the accuracy of listings or resumes, or any interaction between users.

4. User Accounts

4.1 Registration

Certain features of the Service require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at customersuccess@hcareers.comif you suspect unauthorized access to your account.

4.3 Account Types

The Service supports two primary account types:

  • Job Seeker Accounts — for individuals seeking employment in the hospitality industry.
  • Employer Accounts — for companies and organizations purchasing and posting classified job advertisements.

Each account type is subject to additional terms specific to its functionality as described in these Terms.

5. Terms for Job Seekers

By using the Service as a job seeker, you agree to the following:

  • You will only submit career information that is accurate, current, and your own.
  • You understand that when you apply for a job, the employer receives a copy of the information you submit and may retain it in their own systems. We are not responsible for an employer's use, storage, or handling of your information after it is submitted.
  • You accept the risk of applying to confidential job postings, which may be posted by your current employer. You agree to hold the Company harmless if this occurs.
  • You will only respond to job postings for the purpose of seeking employment for yourself.

6. Terms for Employers

By using the Service as an employer, you agree to the following:

  • You are responsible for all content you post, including job descriptions, company information, and any other materials. You confirm that you have the right to post this content and that it complies with all applicable laws.
  • You are responsible for all activity under your account, including actions taken by other individuals who access your account with or without your authorization.
  • You will not post job listings that are inaccurate, fraudulent, discriminatory, or not for bona fide open positions with your organization.
  • You will comply with all applicable employment laws, including laws related to equal employment opportunity, nondiscrimination, and employment eligibility verification.
  • You will not use candidate information obtained through the Service for any purpose other than evaluating candidates for employment with your organization.
  • You will remove job postings promptly when positions are filled or no longer available.
  • You are solely responsible for your hiring decisions. We do not verify or guarantee the qualifications of any candidate.

7. Prohibited Conduct

You agree not to:

  • Post false, misleading, or inaccurate information.
  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Transmit any content that is abusive, defamatory, harassing, hateful, obscene, threatening, or otherwise objectionable.
  • Upload viruses, malware, or other harmful code.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use any automated means (including bots, scrapers, spiders, crawlers, or similar tools) to access, collect data from, or interact with the Service, except through generally available search engines (such as Google or Bing) or with our prior written consent.
  • Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures.
  • Collect, harvest, or scrape user information, including email addresses, from the Service.
  • Resell, redistribute, or sublicense any part of the Service or data obtained from it.
  • Frame, mirror, or create derivative works based on the Service.
  • Use the Service to send unsolicited communications (spam) to other users.
  • Circumvent or attempt to circumvent any access controls, rate limits, or usage restrictions.

8. Content and Intellectual Property

8.1 Our Content

The Service, including its design, text, graphics, logos, software, and all other content created by the Company (collectively, "Company Content"), is the property of Talentronic Corporation and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from Company Content without our prior written consent.

8.2 User Content

You retain ownership of content you submit to the Service ("User Content"), including resumes, job postings, company profiles, and other materials. By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent that you have all necessary rights to submit your User Content and that it does not infringe any third party's intellectual property or other rights.

8.3 User-Posted Content and Copyright

Hcareers is a platform for user-generated content. Job listings, company profiles, logos, photographs, and other materials displayed on the Service are posted by third-party users — not by the Company. The Company does not create, review, verify, or endorse user-posted content, and the Company is not the publisher or author of such content. The user who posted the content is solely responsible for ensuring that it does not infringe any third party's intellectual property or other rights.

8.4 DMCA — Copyright Infringement Claims

We comply with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Service infringes your copyright, your claim is with the user who posted the content, not with the Company. However, you may submit a DMCA takedown notice to our designated agent, and we will process it in accordance with the DMCA:

Your notice must include: (a) a description of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement of good faith belief that the use is unauthorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

We will forward valid DMCA notices to the user who posted the content, who may submit a counter-notification. Misrepresentations in a DMCA notice may result in liability for damages under 17 U.S.C. § 512(f).

9. Third-Party Links and Services

The Service may contain links to websites or services operated by third parties. We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and that third party.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY JOB LISTING, RESUME, COMPANY INFORMATION, OR OTHER CONTENT ON THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALENTRONIC CORPORATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Talentronic Corporation and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

13.2 Arbitration

You and the Company agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in King County, Washington, or at another mutually agreed location.

YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

13.3 Exceptions

Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may terminate your account at any time by contacting us at customersuccess@hcareers.com.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to Sections 8, 10, 11, 12, and 13.

15. General Provisions

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Service.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
